For what purpose and on what basis do we process your personal data?

We process your personal data:

  • on the basis that the processing is necessary for the conclusion and performance of the contract:
    to take action at your request prior to entering into a contract, i.e. to negotiate, prepare an offer, verify data – legal basis Article 6(1)(b) of the GDPR;
  • for the conclusion and performance of the concluded contract – legal basis Article 6(1)(b) GDPR;
  • on the basis of a legal obligation incumbent on the controller, i.e:
  • to comply with legal obligations, i.e. to issue and store invoices for the period determined by law – legal basis Article 6(1)(c) of the GDPR;
  • on the basis of the necessity to process the data to fulfil the controller’s legitimate interest:
  • establishing, defending and pursuing claims – legal basis Article 6(1)(f) of the GDPR, the controller’s legitimate interest;
  • direct marketing, for the duration of the contract, within the limits of our legitimate interest – legal basis Article 6(1)(f).

Who may be the recipients of your personal data?

Your personal data may be forwarded to entities processing them on our behalf, such as entities cooperating with TheTea Wojciech Woźniak in the performance of data processing services in IT systems, an entity processing data for accounting purposes, entities monitoring our service and entities performing order dispatching, marketing services, etc., whereby these entities will process your data for the purpose of the contract. – However, these entities will process data on the basis of a contract concluded with us and only to the extent that they are instructed to do so. In the performance of the above purposes, we will transfer your personal data both within countries that are part of the European Union and outside the European Economic Area in accordance with the provisions contained in the individual contracts.

How long will we keep your personal data?

Your personal data will be stored for the duration of the framework contract and until the statute of limitations for claims under the contract or until the obligation to store personal data under the law, in particular the obligation to store accounting documents relating to the contract, expires.

We will stop processing your personal data for direct marketing purposes, immediately – when you object to the processing in this respect.

What rights do you have with regard to the processing of your personal data?

You can always ask us for access to your personal data. You can also, at any time, exercise your right to rectification of your personal data, erasure or restriction of processing:

  • to the extent that we process your data based on a legitimate interest of the controller, you have the right to object to the processing of your personal data;
  • to the extent that we process your personal data on the basis of your consent, you have the right
  • to withdraw your consent at any time; withdrawal of consent does not affect the lawfulness of the processing we have carried out on the basis of consent prior to its withdrawal.
  • to the extent that we process your personal data for the purpose of entering into and performing a contract or on the basis of your consent, you also have the right to data portability, i.e. to receive your personal data from us, in a structured, commonly used, machine-readable format e.g. .csv, .xml; you can send this data to another personal data controller.

Your provision of personal data is necessary for the conclusion and performance of the contract. Without the provision of personal data, it is not possible to conclude and perform the contract!
