Terms and Conditions of Sale / General Terms and Conditions of Sale for distance contracts, effective as of 01.06.2015.

  1. These Terms and Conditions are an integral part of the sales agreement of the products offered by the company TheTea Wojciech Woźniak with its registered office in Łask, ul. Kosynierów 3/1 using the NIP number 831-160-27-22 and REGON number 361455488 and at the same time define the terms and conditions and principles of its sales.
  2. Sales take place via the Internet between the person placing an order at thetea.pl online shop, hereinafter referred to as the Customer, and TheTea Wojciech Woźniak, hereinafter referred to as the Seller.
  3. The Buyer may be any natural person, legal entity or organisational unit without legal personality, registered in the thetea.pl online shop.
  4. Every customer purchasing products offered by theTea.pl is obliged to read the Terms and Conditions.
  5. The products presented on the web pages of TheTea.pl online shop are the subject of sale.
  6. All products offered at TheTea.pl online shop are brand new, free from physical and legal defects and have been legally introduced into the Polish market.
  7. The seller is obliged to deliver items free of defects in accordance with the provisions of Articles 556 and 5561 – 5563 of the Civil Code Act of 23 April 1964 (i.e. Journal of Laws 2014, item 121 as amended).
  8. The prices of all products presented on the web pages of the TheTea.pl online shop are expressed in Polish Zloty, US Dollars or Euros and include VAT. The gross price of the product does not include the cost of delivery.
  9. The seller updates the offer of its products presented on the web pages of the TheTea.pl online shop on an ongoing basis.
  10. Payment for the fulfilment of the order is made in one of the following ways:
  • by bank transfer, before the delivery of the goods, to the Seller’s bank account (prepayment)
  • cash on delivery, upon the receipt of the parcel
  • via PayPal service – after receiving confirmation from PayPal.
  1. By accepting the Terms and Conditions, the Customer purchasing the offered products agrees to issue and send invoices in electronic form by the Seller, in accordance with the Regulation of the Minister of Finance of 14 July 2005 on issuing and sending invoices in electronic form, as well as storing and making them available to the tax authority or tax inspection authority (Journal of Laws 2005, no. 133, item 1119) and the rules of issuing, sending and storing electronic invoices.
  2. The Customer’s acceptance does not exclude TheTea.pl’s right to issue and send paper invoices.
  3. The Seller shall issue and send invoices in electronic form guaranteeing the authenticity of their origin and the integrity of their content.
  4. Each electronic invoice will be delivered to the Customers via e-mail to the e-mail addresses provided by the Customer in the registration form. A change of the Customer’s e-mail address requires a written or electronic notification to the Seller. If the Customer fails to notify the Seller of a change of e-mail address, correspondence sent to the previous e-mail address is deemed to have been correctly delivered.
  5. Orders in the online shop can be placed via the website (online shop).For this purpose, it is necessary to register a user account on the website www.thetea.pl and accept the provisions of these Terms and Conditions. Orders can be made by e-mail correspondence, at the address available on the shop website.
  6. A registered user has the possibility to:
    • make purchases in the online shop TheTea.pl,
    • is entitled to receive individual discounts,
    • is entitled to participate in promotions and competitions,
    • submit reviews on teas without the need for moderation and approval on our part,
  7. After registration, the customer will receive a link to the account activation website at the e-mail address provided. The activation allows you to log into the system.
  8. In order to register correctly, all fields of the registration form containing the data required to create a user account must be completed.
  9. By registering a user account, the Customer:
    • agrees to have his/her contact details placed in the TheTea.pl database and processed in accordance with the Personal Data Protection Act of 29.09.1997 (Journal of Laws No. 133 item 883). The data will be used exclusively for:
      performance of the contract by the Seller,
    • should accept the provisions of the Terms and Conditions of Sales of the online shop TheTea.pl,
    • may agree to receive information about promotions and news.
  10. Providing personal data in the registration form is voluntary, although necessary for the performance of the sales contract concluded with the Seller. The customer has the right to access and correct their data.
  11. You will be notified of the changes to the Terms and Conditions when you log in for the first time after the changes to the Terms and Conditions take effect. Acceptance of the changes to the Terms and Conditions is done by confirming/clicking the message on the login page of TheTea.co.uk. Refusal to accept the changes to the Terms and Conditions is tantamount to de-registration from the TheTea.pl service, with the proviso that the User participates in transactions initiated before the termination of the agreement on the basis of the Terms and Conditions in force on the date of their commencement. The change of the Terms and Conditions does not affect the acquired rights of the users of TheTea.pl service.
  12. Amendments to the Terms and Conditions become effective no less than 7 days after the amended Terms and Conditions are made available on the website of TheTea.pl, with the reservation that transactions started before the amendments become effective are carried out on the existing terms and conditions. The user accepts the changes to the Terms and Conditions by clicking/confirming the message on the login page of the TheTea.pl website.
  13. To purchase products from the TheTea.co.uk online shop, you need to click on the selected product and place an order.
  14. The validity period of the placed order is 10 days. If the customer can’t be contacted within this period, the order is automatically cancelled.

DELIVERY

  1. Shipping prices are specified in the delivery price list.
  2. The dispatch time of orders does not exceed 5 working days from the date the payment is credited to the Seller’s account (does not apply to orders placed in the pre-sale mode).
  3. The ordered goods are dispatched by the Shop via shipping companies (e.g. the Polish Post Office or a courier company) or made available for collection by the customer at the company’s premises.
  4. If payment is made by means other than cash on delivery, the dispatch time is extended by the period between placing the order and the date on which the amount due is credited to the Store’s bank account.
  5. The ordered goods are dispatched by the Store via dispatch companies (e.g. the Polish Post Office or a courier service) or made available for collection by the customer at the company’s premises.

COMPLAINTS

  1. The basis for accepting a complaint is the presentation by the Customer of proof of purchase of the goods.
  2. In the case of non-conformity of the goods with the contract, the Customer should send back to the Store the goods complained of together with a description of the non-conformity.
  3. The Store responds to the Customer’s complaint within 14 working days of returning the goods together with a description of the discrepancy.
  4. If the fulfilment of a justified complaint involves sending the Customer new goods or removing the non-conformity, the costs of delivery will be borne by the Store.
  5. Individual settings of the Customer’s computer and monitor causing erroneous or distorted display of information about the goods (e.g. colours) cannot constitute grounds for complaint.

WITHDRAWAL FROM THE CONTRACT

  1. A customer who has concluded a distance contract may withdraw from it in writing without giving any reason within 14 days from the date of delivery of the goods. The declaration of withdrawal should be sent to the address of the registered office of TheTea Wojciech Woźniak (indicated in Title I, point 1 of these Regulations). TheTea makes it possible to submit the declaration also electronically at the e-mail address:tea@thetea.pl
  2. The goods should be sent back immediately after the declaration of withdrawal from the contract, no later than within 14 days in an unaltered condition.
  3. The costs of direct sending back (return) of the goods to the Seller in connection with the withdrawal from the contract without stating a reason within 14 days from the date of delivery of the goods shall be borne by the Customer.
  4. If the Customer has chosen a method of delivery other than the cheapest ordinary method of delivery offered by the trader, the trader shall not be obliged to reimburse the consumer for the additional costs incurred by him/her.

 INTELLECTUAL PROPERTY

It is forbidden to use any materials published on the Store’s website (including photographs and descriptions of goods) without the Store’s written consent.
